A Muslim man from Rotherham who pleaded guilty to sexually assaulting a teenager on a train has escaped a jail sentence thanks to “previous good character”, despite the judge saying that the offence merited a custodial sentence.

The defendant, Raja Hussain, attempted to excuse his actions by explaining that he was suffering from poor mental health, including depression with psychotic features, hallucinations and delusional beliefs at the time of the assault, the Express has reported.

Hussain, 39, was arrested in Rotherham 24 hours after following an 18 year old University of Sheffield student, onto a train and touching her. The teenager first spotted Hussain grinning at her in a train station waiting room. The two then boarded a train, where Hussain sat opposite her and continued leering.

The passengers were then asked to change trains due to a problem, and when they moved to the second train, he sat down beside her. He immediately began to look at pornography on his phone in a manner designed to ensure the student could see the images, an action which was described as “intimidating”.

Catherine Duffy, prosecuting, said Miss Duffy said: “The defendant was looking at pictures of naked women on his mobile phone. He moved closer to the complainant and began to take off his jacket. As he did so he touched her.”

The terrified girl attempted to move away, but as she did so he maintained contact and proceeded to touch her leg whilst smiling at her. She attempted to deflect his attention by pretending to text her boyfriend, in fact sending several messages to her mother, including one that read “I think this man is trying to stalk me. I actually feel sick”.

Hussain eventually left the train. After the doors had closed the student was quick-minded enough to covertly snap a photo of him through the window, which she handed over to British Transport Police once she reached her destination. Police were able to use the photo to make an appeal, and Hussain was apprehended within 24 hours.

The girl has been left too traumatised by her ordeal to use the rail network since the event, which took place last October.

Judge Paul Watson QC, ruling on the case said “She is to be commended for the fact that she stuck to her guns and brought this to the attention of the authorities.

“People who randomly sexually assault members of the public must expect custodial sentences. What makes it serious is the element of fear this causes others.

“She was brave enough and alert enough to report him and give the police information which eventually led to his arrest and eventual plea of guilty.”

Hussain was sentenced to an eight month jail term, but it was suspended thanks to “good character”. That means that, if he complies with a number of measures, he will escape jail altogether. He was also handed an Antisocial Behaviour Order (ASBO) preventing him from using trains for the next three years.

The incident took place in Rotherham, the scene of the recent child abuse and rape scandal wherein Pakistani rape gangs groomed and raped over 1400 children. Breitbart Londonunderstands that police have dozens of files open on rape gangs in the area.

Education officer admits making indecent images of children

A children’s services council officer has admitted making more than 600 indecent images of children.

Robert Finlay, 53, of Barnes Crescent, Bournemouth, pleaded guilty to 17 counts of making the images between 1 January 2009 and 10 April.

Bournemouth Crown Court heard 91 of the 601 images were rated at levels four and five – the most serious level.

Finlay has been dismissed from his post as children’s services programme leader at Bournemouth Borough Council.

‘Shocked and stunned’

Jane Portman, the council’s executive director for children’s and adult services, said: “This has been a difficult time for all those in Children’s Services and many in the wider council, with staff genuinely shocked and stunned that one of their own colleagues has committed such serious crimes.

“We have robust recruitment processes in place at the council and full background checks, including Criminal Records Bureau disclosures, are made on any individual coming to work in Children’s Services.

“The case was no different with this individual, who came back with a clean record.”

Ms Portman said Finlay was suspended as soon as the council was alerted to the situation.

He was dealt with through the council’s disciplinary proceedings and later dismissed.

Finlay was bailed to reappear at Bournemouth Crown Court to be sentenced on 16 August.

A RETIRED priest has been jailed for ten years for abusing children as young as five, including two at the Middle Wallop army base.

Gordon Rideout, 74, from East Sussex, was found guilty of two attempted rapes and 34 indecent assaults on 16 boys and girls by a jury at Lewes Crown Court. He was jailed for ten years on Monday.

The attacks took place between 1962 and 1973, and four charges of indecent assault were related to two girls at the Middle Wallop army base, where he was a padre at St Michael’s Church.

In 1972 he was accused of three indecent assaults at the base, but was cleared by a military hearing.

The majority of the offences took place when Rideout was the assistant curate at St Mary’s Church in Southgate, Crawley from 1962 to 1965 and he would regularly visit a Barnardo’s children’s home, Ifield Hall.

Nigel Pilkington, head of the CPS South East Complex Casework Unit, said: “Gordon Rideout was in a position of trust, which he systematically abused, indecently assaulting vulnerable youngsters that he met over a number of years.

“A number of his victims attempted to speak out about what Rideout was doing, but tragically at the time of the offences, a child’s word was not believed.

“Those who were brave enough to say anything were subjected to brutal beatings. Some of his victims told police in interviews that it simply ‘wasn’t worth complaining’ because of the punishment they would receive in return.

“Instead the victims hid what happened to them for many years and none of us can begin to imagine the impact that has had on their lives. I would like to pay tribute to the bravery and the fortitude of the victims in coming forward to give evidence.

“They may not have been believed as children, but today they finally have been. I hope that helps to give them closure.”

He also thanked Barnardo’s for the role it played in helping bring the case to trial.

Waltham Forest Met PC found guilty of child porn charge

A Metropolitan policeman based at Waltham Forest has been found guilty of making indecent images of children.

PC Adam Holbrook, 29, had denied making 16 images of children in erotic poses.

On Thursday at Westminster Magistrates’ Court he was ordered to pay a £640 fine and £450 in prosecution costs.

He will be placed on the sex offenders register.

PC Holbrook has been suspended pending the outcome of a disciplinary hearing.

PC Holbrook received a commendation in 2007 for his work on the investigation into the murder of Richie Holmes in Chingford.

Mr Holmes, 21, was shot dead in Greenham Crescent in 2005 and PC Holbrook was praised for his work at the scene along with nine other officers.

BREAKING NEWS: Former teacher jailed for child sex abuse

A FORMER schoolteacher has been jailed for using his role as a rugby coach to exploit a teenage boy and subject him to a catalogue of sexual abuse

Keith Ruby was found guilty of 16 sexual offences against the youngster by a jury in December, and today (Fri) a judge has sentenced him to 10 years in jail.

The court had heard that the 36-year-old had met the teenager, who was a promising young rugby player, when he was teaching at the prestigious Sidcot School near Winscombe in 2004.

Ruby developed a relationship with the youngster, who cannot be named for legal reasons, when the pupil was 12.

The trigger for the abuse was the victim’s realisation that he was gay, which he shared in confidence with Ruby, who started asking him questions about his sexuality and then began physically molesting him.

The abuse started when the victim was 14 and lasted for about a year. It took place during massage sessions at the victim’s home, in the changing rooms at both Weston and Winscombe rugby clubs and on an overseas rugby trip.

The court was told Ruby, of Biddisham Lane in Biddisham, had worked himself into a position of trust with the victim’s family, who had believed he was giving their son one-on-one sessions to further his development as a rugby player.

Although a police investigation was launched in February 2006 after allegations about the abuse came to light, the final offence occurred after the investigation was launched.

The initial investigation collapsed in July 2006, but a fresh probe was launched in 2011 when the victim told his parents about the catalogue of abuse.

Ruby denied all 20 allegations relating to the victim, but on December 6 the jury at Taunton found him guilty by majority verdict of 11 counts of engaging in sexual activity with a child and five counts of penetrative sexual activity with a child.

They found him not guilty of two counts of causing or inciting a child under 13 to engage in sexual activity and two counts of sexual assault on a child under 13.

The Mercury had been prevented on reporting on the trial and its outcome by a court order, which was lifted this morning.

Ruby was also handed a sexual offences prevention order, forced to sign the sex offences register for life and has been placed on a barring list to prevent him from working with children again in the future.

A NEW Haw cub scout leader who sexually abused a young boy and collected indecent images of children has been jailed for three years.

Daniel Bisacre, 32, from Knaphill, cornered the boy, who he met through the scout movement, and performed an indecent act on him in two separate incidents.

Bisacre, who was found guilty of two counts of sexual activity with a child by Guildford Crown Court on November 14, was a former leader of the 2nd New Haw Scout Group.

The boy joined the cub scout movement in a different group to the one run by the defendant.

At his sentencing on Friday, Judge Christopher Critchlow said: “As a scout leader you of course were trusted by parents of the boys in your charge, whether on a trip somewhere or on a scout camp. With your actions you breached that trust.”

The court heard how Bisacre, of Tringham Close, had also been found guilty of child pornography charges in September 2011, after more than 800 indecent images of young boys were found on his computer.

Mr Critchlow added: “I hope while you are in custody that you take the opportunity to address your behaviour. I certainly hope that there won’t be any further offending of this nature.”

In mitigation, Amanda Hamilton, defending, said Bisacre had lost everything following his convictions and had been verbally abused by other prison inmates who heard about the nature of his crimes.

“Despite the publicity of this case, his family has continued to have positive contact with the scouts, including the families of of boy scouts that he looked after,” she said.

“It goes to show how he was viewed by people. Nothing negative has come from anybody towards him and his family.”

Mr Critchlow said: “Before you committed these offences you were a man of good character. You are now 32 and the have lost that good character and through this offence you have lost a great deal.

“You have lost your job, your pension and your involvement with the scouts.”

Bisacre was given a 27-month prison sentence for the two counts of sexual activity with a child and a consecutive nine-month sentence for the possession of indecent images.
