A PAEDOPHILE who downloaded indecent images of children has avoided a prison sentence.

Brian Stretton, 65, was caught after Essex police investigated a website from where he had been downloading images.

Portsmouth Crown Court heard that one of the children in the 12 images found was aged eight years old and another 10.

Police also found 200 pictures of extreme pornography on his laptop.

Prosecuting, Tammy Mears said Stretton only admitted his guilt to police when they confronted him with evidence from his laptop and then he said that he had been looking at the pictures ‘out of curiosity’ not to get sexual kicks.

The court heard Stretton had begun to search for the images after chatting with young girls online, and Judge Roger Hetherington said police had already given warnings to the families involved.

Simon Moger, defending Stretton, told the court: ‘This defendant was motivated by a combination of curiosity, naivety and in some aspects, an underlying interest in the sexual content of these images.’

Stretton pleaded guilty to eight counts of possession of indecent images of children.

He also admitted four counts of extreme pornography featuring bestiality, which he had viewed on November 26.

Mr Moger said: ‘The picture of this defendant is a somewhat isolated and vulnerable individual which in some extent led to these offences being committed in the first place.

‘He appears to be a man who has spent a number of years avoiding problems in terms of his general health, mental health and that sort of thing.’

He said Stretton, who is previously of good character, had become lonely and depressed after his marriage broke down and that he stood to lose his home if he was sent to prison.

Judge Hetherington sentenced Stretton, from Wingfield Street, Buckland, Portsmouth to a three-year suspended prison term.

Stretton was ordered to attend a Sex Offenders’ Treatment Programmes.

He was put under supervision for three years.

Stretton was also ordered to sign the Sex Offenders’ Register.

His name will remain on the register for five years.

A forklift truck driver who had more than 700 indecent images of children has received a suspended sentence.

An image involving bestiality was also found on the computer of Richard Scott, of Blandford Road, Whitley, a court heard.

The 54-year-old claimed to have stumbled upon the images which were contained on an innocent website which had been hacked in to. But the judge at Reading Crown Court said he believed Scott had deliberately found the “disgusting” images of children who were clearly under the age of 18.

The court heard police arrested Scott at his home on April 10, last year, and took his Dell computer.

Detectives traced him through his visits to the website.

Michael Harrison, prosecuting, said: “He was interviewed and admitted he was addicted to adult pornography and one day, while viewing that, he went to a link and found indecent images of children and when he realised what it was he shut the computer down.”

However, he continued to visit the site and detectives found 722 indecent images of children on his computer ranging from the least to the most serious involving bestiality.

Janetta Davies, defending, told the court: “What he told police was he had stumbled upon an image by accident and deleted it immediately.

“Then it became a strange fascination and something he couldn’t stop going back to look at over a period of two years.”

She said the divorced father had worked for a large company as a forklift driver for 23 years and had no previous convictions or cautions.

Judge Peter Ross, sentencing on Tuesday, June 18, said: “I have to deal with you for offences which are rightly regarded by the general public as disgusting.”

He continued: “Around the world, in order to satisfy the perverted desires of people like you, children are abused and that abuse is recorded and the internet, regrettably, makes these images available to the likes of you.

“It has been put before me you stumbled upon these images. No, you didn’t. You clearly were one of a trusted few people who were given the opportunity to access an innocent website which had been hacked and on that site had been placed images of child abuse.

“That demonstrates an additional sophistication in relation to these offences which I have yet to see before me in the course of my work and that is sitting as a judge or recorder for 14 years.”

However, Judge Ross said he had to take into account Scott’s previous good character and his early guilty plea.

He sentenced Scott to six months’ jail suspended for two years under supervision. He ordered him to pay a £5,000 fine, £340 costs and a victim surcharge of £80 and required him to sign the sex offenders register for five years.

Graham Ovenden sex crimes: Artist gets suspended sentence

Renowned Cornwall artist Graham Ovenden has been given a suspended sentence for indecency offences against young girls.

Ovenden, 70, was convicted of six counts of indecency and one of indecent assault at Truro Crown Court in April.

He had denied the charges, which dated back about 40 years and occurred in London and Cornwall.

At Plymouth Crown Court, Judge Graham Cottle sentenced Ovenden to 12 months, suspended for two years.

‘Mindless witch hunt’

The judge said the purpose behind Ovenden’s actions “was undoubtedly sexual”, but added that sentencing the artist was a difficult exercise.

Judge Cottle said he had to take into account the gravity and impact of his crimes.

He also said he had to consider his age, his health and self-inflicted punishment, such as the damage to his reputation as an artist which had been “severely tarnished”.

Leaving court, Ovenden told the BBC he was planning to appeal after a “mindless witch hunt”

He said: “I have not the slightest intention of making an apology for crimes I have not committed.”

He added that there was “no evidence against me” and refused to acknowledge victim impact statements, claiming they were written by police.

Pervert David Kemsley claimed he did not molest girl for sexual reasons

A pervert who maintains he did not molest a young girl for sexual reasons has walked free from court.

David Kemsley fondled the victim’s breasts, slapped her bottom and kissed her, putting his tongue in her mouth.

Because of the 51-year-old’s claim his behaviour was not sexually motivated, he could not be recommended for sex offender treatment.

A judge said sentencing guidelines indicated a starting point of a community order, but he added: “It is the persistence of it and I can’t help thinking it should be marked by something a little bit stronger.”

Kemsley, of Valerian Close, Chatham, was sentenced to nine months imprisonment suspended for two years after admitting sexual assault and sexual activity with a child. He will also have to complete 200 hours unpaid work.

Andrew Espley, prosecuting, said Kemsley had tried to unclip the teenage girl’s bra, asking her: “Do you like it?” She replied that she didn’t and pushed his hands away.

His hands moved towards her breasts before going to her stomach. He put his finger in his mouth and then her mouth.

 

“It left her feeling scared,” Mr Espley told Maidstone Crown Court. Kemsley had touched her breasts over her clothes on other occasions.

Judge Charles Byers said it was disappointing that Kemsley did not accept his behaviour had a sexual motive.

“One asks what on earth was he doing stroking her breasts? What was he doing it for?”

Tom Stern, defending, replied: “Some are quick to put their cards on the table. Others struggle to make that acknowledgement.”

The judge said: “Until he accepts this was sexually motivated he cannot be helped by the excellent Thames Valley sex offender programme.

“I have to ask myself: Is it in anybody’s interest to ask him to serve a custodial sentence immediately? The message has to go out that a custodial sentence will be imposed when young children are abused. It is as simple as that.

“The positive side is he is in work and of previous good character. The complainant wants closure and to get on with her life.”

Judge Byers told Kemsley: “I hope you will do a lot of soul-searching in the next few months and appreciate the harm you could have done to that child.”
